The alleged perpetrator will normally be given a restraining order not to go within say 500 feet from the alleged victim- this includes the victim’s home, work or place of business. Any violation of the restraining order will lead to the filing of one or more new criminal charges against the person already facing the domestic violence or battery charge.

The accused is not only faced with having to go before a judge in criminal court, but another judge in family court that will address whether the restraining order is temporary or permanent. Indeed, anyone charged with domestic violence has a lot of legal issues facing them.
